1. Eligibility
- The Challenge is open to individuals aged 18 or older at the time of entry. Participants (an individual who has submitted an entry to the Challenge”) under the age of 18 must have parental or guardian consent.
- All forms of art are eligible, including but not limited to music, dance, painting, and other creative performances.
- Employees of The Miami Foundation and their immediate family members (mother, father, brothers, sisters, sons, daughters and spouse, regardless of where they reside) are eligible to participate but not eligible for prizes.
- Participants and potential winners are required to provide proof of identification to The Miami Foundation.
2. Challenge Period
- The Challenge begins on September 20, 2024 at 12:00pm EST and ends on November 1, 2024 at 11:59pm EST. Entries submitted after the deadline will not be considered.
3. How to Enter
- Participants in the Challenge must create an original artistic performance (song, dance, painting, etc.) that is inspired by the culture, diversity, and spirit of Miami.
- Each entry by a Participant must include a reference to Give Miami Day and support for a local nonprofit or cause participating in Give Miami Day.
- Each entry must be submitted via social media (Instagram or TikTok) by tagging The Miami Foundation and using the hashtag #GiveMiamiDay.
4. Content Requirements
- The performance or artwork must be original and created solely by the Participant.
- The content of the entry must not contain any material that is unlawful, discriminatory, offensive, or violates the rights of any third party.
- Entries should reflect the essence of Miami through cultural, historical, or iconic references to the city.
- Submissions must be appropriate for public viewing and comply with the terms and policies of the platform (Instagram, TikTok) on which they are posted. Additionally, The Miami Foundation, in its sole discretion, can determine what the organization deems appropriate for its audience.
- Winning a prize is contingent upon fulfilling all requirements set forth herein.
5. Prizes
- The Miami Foundation will select one qualifying Participant as the Winner of the Challenge based on the creativity and impact of the submission.
- The Winner will be awarded a $1,000 prize, and the ability to direct a $1,000 charitable donation to the local nonprofit participating in Give Miami Day. The Winner is exclusively advising the on the charitable donation and will have no incident of ownership over the charitable portion of the prize.
- The Winner’s winning submission may be featured at the Give Miami Day Unity Breakfast/Mission Control event.
6. Selection of Winner
- The Participants entries will be judged on creativity, alignment with the theme of Miami's culture and diversity, and overall impact.
- A panel of judges appointed by The Miami Foundation will review submissions and select the Winner.
- The Winner will be notified no later than November 15, 2024 via direct message on the platform they used to submit their entry. If the Winner cannot be contacted within two days, a new Winner may be selected.
- A potential winner may be required to complete and return an affidavit of eligibility and liability/publicity release. If a potential winner fails to sign and return these documents within the required time period, an alternate potential winner may be selected. The Winner must execute liability/publicity releases prior to issuance of prizes.
7. Use of Entries
- By submitting an entry, Participants grant The Miami Foundation a non-exclusive, royalty-free, worldwide license to use, reproduce, and display their work on its social media platforms, website, and any promotional materials.
- The Miami Foundation reserves the right to feature selected Participants entries, including entries that were not selected as the winner, in promotional activities, including but not limited to announcements, press releases, and public events.
8. Intellectual Property
- Participants retain ownership of their submissions. However, Participants acknowledge that their submission may be used by The Miami Foundation as outlined herein.
- It is the sole responsibility of the Participants to ensure that their entry does not infringe on any intellectual property rights of third parties, including music, images, or other copyrighted material.
9. Limitation of Liability
- The Miami Foundation is not responsible for any technical issues, including but not limited to problems with social media platforms, internet connectivity, or entry submissions.
- As a condition of entering the Challenge, the Participants agree to release and hold harmless The Miami Foundation from any liability, claims, or damages arising out of participation in the Challenge or acceptance of any prize. The Participant further agrees to waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
10. Disqualification
- Any entry that violates these terms and conditions or contains inappropriate content may be disqualified at the sole discretion of The Miami Foundation.
- Entries that are incomplete, do not meet the submission criteria, or fail to adhere to the Challenge theme may also be disqualified.
11. Privacy
- The personal information of Participants will be collected and used in accordance with The Miami Foundation’s privacy policy.
- The personal information of the Particpant’s will be used for the purpose of administering the Challenge and notifying the winner.
- The Winner agrees to have their name, likeness, image and/or photograph used on social media, print or advertisement related to this Challenge or similar.
12. General Conditions
- The Winner are responsible for all taxes and fees associated with prize receipt and/or use.
- The Miami Foundation is not responsible for incomplete or incorrect entries.
- The Miami Foundation reserves the right to modify, suspend, or terminate the Challenge at any time, for any reason.
- By entering this Challenge, entrants agree to these Terms & Conditions.
